Before you can work in Germany it is necessary, for a refugee, to apply for asylum. You will then be classified in one of several resident status. The obtained status is decisive for the further course of your job opportunities in Germany. The Federal Office for Migration and Refugees (BAMF) awards three so-called "residence permits" (there exist different types of entry and residence permit):
- Persons with a residence permit (Aufenthaltserlaubnis)
- Persons with a temporary resident permit (Aufenthaltsgestattung)
- Persons with a temporary suspension of deportation (Duldung)
For persons with a residence permit, the Federal Ministry for Migration and Refugees decides on four types of protection within the asylum procedure. The respective type of protection determines the duration of the residence permit. Furthermore, you have the option to change your permit to a permanent residence permit.
If you receive a positive decision, you will be able to work in Germany.
If you have only received a deportation ban, the immigration authority decides in the further course, whether a permit for employment can be granted.n.
Persons with a temporary residence permit are still in the asylum procedure. This status allows you to stay in Germany and work under certain conditions.
If a person possesses a Duldung, it means that their application was rejected for asylum but not have they are not being deported back to their home country. In this case, there are special rules that apply in order to access the labour market (please refer to the website of the BAMF - Federal Office for Migration and Refugees).
The following diagram illustrates the different stages that an asylum seeker will go through:
